{"id":3303,"date":"2014-08-20T15:10:36","date_gmt":"2014-08-20T14:10:36","guid":{"rendered":"https:\/\/sweet-wozniak.167-235-21-219.plesk.page\/?p=3303"},"modified":"2022-08-18T16:25:57","modified_gmt":"2022-08-18T14:25:57","slug":"geschil-op-vakantie","status":"publish","type":"post","link":"https:\/\/blog.europ-assistance.be\/nl\/geschil-op-vakantie\/","title":{"rendered":"Een geschil op vakantie"},"content":{"rendered":"<p><em><strong>Wat kunt u doen indien er een geschil ontstaat tussen uzelf en\u00a0de uitbater of de beheerder van uw hotel of logement naar aanleiding van een duidelijke niet-naleving van de reserveringsmodaliteiten?<br \/>\n<\/strong><\/em><\/p>\n<p><!--more--><\/p>\n<h2>\u201cDit is niet wat we geboekt hebben!\u201d<\/h2>\n<p>Sommige toeristen hebben tijdens hun vakantie helaas te kampen met onregelmatigheden ten overstaande van het logement of de reis die ze geboekt hebben. Zo is het mogelijk dat het\u00a0logement niet overeenkomt met de beschrijving van de reserveringsbon, dat de infrastructuur uitermate vuil, gevaarlijk of niet operationeel is, dat de opties waarvoor reeds betaald werd onbestaand zijn, enz.<\/p>\n<h2>Wat kunt u doen?<\/h2>\n<p>Welke procedure kunt u volgen indien dit zou voorvallen om het probleem op te lossen of schadevergoeding te krijgen?<\/p>\n<ul>\n<li>Vooreerst moet u goed de inhoud van uw\u00a0<strong>contract nakijken evenals de beschrijving van de reservering<\/strong>\u00a0die u met het hotel, het reiskantoor of de touroperator hebt afgesloten. Indien u overtuigd bent dat u in uw rechten bent, tracht u eerst een oplossing te vinden via een\u00a0<strong>minnelijke schikking<\/strong>\u00a0met de beheerder of de uitbater\u00a0van het hotel of van het logement.<\/li>\n<li><span style=\"line-height: 1.5em;\">Indien er geen oplossing wordt aangeboden, kunt u uw\u00a0<\/span><strong style=\"line-height: 1.5em;\">klacht overmaken aan de plaatselijke vertegenwoordiger\u00a0<\/strong><span style=\"line-height: 1.5em;\">van uw touroperator of van uw reiskantoor. Neem contact op met uw reiskantoor in Belgi\u00eb en\/of met de klachtendienst van uw touroperator in Belgi\u00eb en vraag hem het probleem op te lossen of minstens het probleem te registreren (vraag een dossiernummer aan).\u00a0<\/span><\/li>\n<li><span style=\"line-height: 1.5em;\">ndien er ter plaatse geen bevredigende oplossing wordt gevonden:\u00a0<\/span><strong style=\"line-height: 1.5em;\">verzamel alle bewijsmateriaal\u00a0<\/strong><span style=\"line-height: 1.5em;\">(foto\u2019s, films, getuigenissen van derden, \u2026) dat nuttig kan zijn indien u van plan bent een offic\u00eble klacht in te dienen bij de touroperator, het reiskantoor of de verhuurder na terugkeer in Belgi\u00eb.<\/span><\/li>\n<\/ul>\n<h2>De Geschillencommissie Reizen<\/h2>\n<p>De <span style=\"color: #000080;\"><strong><a title=\"Geschillencommissie Reizen\" href=\"http:\/\/economie.fgov.be\/nl\/consument\/Reizen\/Geschillencommissie_Reizen\/\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #000080;\">Geschillencommissie Reizen<\/span><\/a><\/strong><\/span>\u00a0zal slechts kunnen tussenkomen indien de touroperator, het reiskantoor of de verhuurder er zich bij aangesloten heeft. Zie hiervoor de algemene voorwaarden van de touroperator of van het reiskantoor die u gewoonlijk in zijn brochure of reserveringsbon kunt vinden.<\/p>\n<p>De\u00a0<span style=\"color: #000080;\"><a title=\"Geschillencommissie Reizen\" href=\"http:\/\/economie.fgov.be\/nl\/consument\/Reizen\/Geschillencommissie_Reizen\/\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #000080;\">Geschillencommissie Reizen<\/span><\/a><\/span> is <strong>niet bevoegd<\/strong> in een aantal gevallen:<\/p>\n<ul>\n<li>indien het geschil lichamelijke letsels betreft;<\/li>\n<li><span style=\"line-height: 1.5em;\">indien het een reisverzekering of een bijstand betreft die geen deel uitmaakt van\u00a0het reisforfait;\u00a0<\/span><\/li>\n<li><span style=\"line-height: 1.5em;\">indien het geschil slaat op een niet contractuele verplichting.<\/span><\/li>\n<\/ul>\n<p>De <span style=\"color: #000080;\"><a title=\"Geschillencommissie Reizen\" href=\"http:\/\/economie.fgov.be\/nl\/consument\/Reizen\/Geschillencommissie_Reizen\/\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #000080;\">Geschillencommissie Reizen<\/span><\/a><\/span> zal uw dossier slechts kunnen aanvaarden indien u een offici\u00eble klacht hebt ingediend bij de verhuurder of de organisator van de reis\u00a0<strong>binnen de maand na uw terugkeer<\/strong>\u00a0(of binnen de maand na de vertrekdatum indien de reis niet heeft plaatsgevonden) <strong>en dat u gepoogd hebt om\u00a0binnen de 4 maanden een minnelijke schikking\u00a0te vinden<\/strong>.<\/p>\n<p>Indien er geen akkoord gevonden werd, beschikt u over een termijn van \u00e9\u00e9n jaar om bij de <span style=\"color: #000080;\"><a title=\"Geschillencommissie Reizen\" href=\"http:\/\/economie.fgov.be\/nl\/consument\/Reizen\/Geschillencommissie_Reizen\/\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #000080;\">Geschillencommissie
